David Wilson spoke at DRI’s Corporate Counsel Roundtable in October 2021. The Ethics Presentation was entitled “Keeping Secrets: The Practical, Legal and Ethical Implications of Maintaining Confidentiality in Discovery.”  This talk analyzed recent trends in various plaintiff’s attorney organizations and list-serves to share confidential information obtained through discovery and resistance to reasonable protective orders in order to prevent unauthorized dissemination.  Proactive steps to be taken by parties to identify protectable trade secrets were discussed and ethical implications in the determination of what constitutes a trade secret and advice to clients regarding same. The paper submitted with the presentation was also published in DRI’s In-House Defense Quarterly (Fall 2021) magazine.
