Tracy Hendrix and Rachael Schexnailder obtained a defense verdict in favor of their client in a disputed liability car accident. The Defendant was traveling eastbound on 28th Avenue South attempting to make a left-hand turn onto 18th Street South with a yellow traffic light, and the Plaintiff was traveling westbound on 28th Avenue South proceeding straight with the yellow traffic light. The Defendant testified she felt she had plenty of time to execute the left-hand turn. There was some dispute as to how far the Plaintiff’s vehicle was from the Defendant’s vehicle prior to the Defendant executing the left-hand turn. The Defendant testified the Plaintiff was speeding, which the Plaintiff disputed. The investigating officer testified at trial that he could not determine who the prime contributing unit was. The Plaintiff claimed injures to her neck and back. The Plaintiff’s treating physician testified at trial and related the Plaintiff’s injuries to the accident. The Plaintiff further claimed that she was permanently injured in this accident. The defense impeached the Plaintiff with posts on her social media account showing her playing with the children she nannied for, showing posts with them on her upper back and also questioned her about her taking care of a gentlemen with cerebral palsy which required her to do a good bit of manual work and lifting. In closing, the defense asked the jury to return a verdict in favor of the Defendant and asked them to return a verdict no more the $1,000-$5,000 should they find in favor of the Plaintiff. The Plaintiff asked the jury to return a verdict 10 times the amount the defense suggested. After deliberating for 30 minutes, the jury returned a verdict in favor of the Defendant.
