Daniel Newton and Marc Jaskolka obtained a defense verdict in favor of their client in a disputed causation car accident case. The plaintiff claimed an exacerbation of her neck and back pain, as well as peroneal nerve compression in her right ankle. A treating physician testified the plaintiff’s injuries were related to the accident. The plaintiff testified that immediately following the accident she felt as if her back had been broken and testified she told the police officer about that pain. Defense counsel impeached her testimony with the testimony of the investigating officer who testified had she reported the pain, he would’ve noted it in his report. In closing, Plaintiff’s counsel asked the jury to return a verdict in favor of the Plaintiff in the amount of $275,000. After deliberating for 2.5 hours, the jury returned a verdict in favor of the Defendant.
